Hak Politik Keterwakilan Perempuan dalam Sistem Proporsional Representatif pada Pemilu Legislatif

Abstract

Hak politik keterwakilan perempuan dalam Pemilu legislatif di Indonesia, diatur dalam UU Nomor 12 Tahun 2003, beberapa kali perubahan hingga menjadi UU Nomor 7 tahun 2017 tentang Pemilihan Umum. Penelitian ini menggunakan metode yuridis normatif, dengan pisau analisis kualitatif dengan perbandingan penerapan di beberapa negara bersistem presidensial. Kajian ini menunjukkan bahwa hak politik keterwakilan perempuan dalam pemilu legislatif diatur dalam UU Nomor 7 Tahun 2017 tentang Pemilihan Umum. Hak politik keterwakilan perempuan dalam sistem Pemilu proporsional representatif pada pemilihan anggota legislatif memenuhi prinsip inklusi, disamping itu, proporsional representasi juga memberikan kesempatan bagi semua partai untuk memaksimalkan keseluruhan suara yang mereka dapatkan. Sistem Proporsional Representatif terbuka memberikan kesempatan yang sama untuk tiap-tiap kandidat baik pria maupun perempuan, pemberian sanksi kepada partai yang tidak memenuhi syarat minimal 30% keterwakilan perempuan sebagai peserta Pemilu, akan memberikan kesempatan yang lebih besar bagi keterwakilan perempuan di parlemen.

Abstract. The political rights of women's representation in legislative elections in Indonesia are regulated in Law Number 12 of 2003, several times being amended to become Law Number 7 of 2017 concerning General Elections. This study uses a normative juridical method, with a qualitative analysis knife with a comparative application in several countries with presidential systems. This study shows that the political rights of women's representation in legislative elections are stipulated in Law Number 7 of 2017 concerning General Elections. The political rights of women's representation in the representative proportional electoral system in the election of legislative members fulfill the principle of inclusion, besides that, proportional representation also provides an opportunity for all parties to maximize the overall votes they get. The open Proportional Representative System provides equal opportunities for each candidate, both male and female, imposing sanctions on parties that do not meet the minimum requirement of 30% female representation as election participants, will provide greater opportunities for women's representation in parliament.
